Equine Sports Performance® (“Company”, “we”, “us” and or “our”) wants each user of the site (“you”, “your”, “customer”) to please read our terms and conditions carefully as your usage of the site and or purchase indicates your acceptance of our terms and conditions. By using our website or purchasing from company you are bound to the terms and conditions of this agreement. We reserve the right to change, modify or discontinue the terms and conditions of this agreement at any time.
GENERAL INFORMATION
These Terms of Use constitute the entire agreement between the Company and you and govern the use of the site. You may also be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software. Our failure to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties intentions as reflected in the provision, and the other provisions of the terms and conditions will remain in full force and effect.

DELIVERY
Unless contract specifies the means by which goods are to be delivered, Company will choose the means of transport, the cost of which will be included in postage and handling charges. The delivery will be made to the customers nominated address unless otherwise agreed upon by the Company.
The Company shall not be liable in any way for any loss or damage (including loss of trade or profit and economic loss) incurring to the customer in the event that delivery or supply of the goods or services ordered is frustrated or delayed by any circumstances beyond the reasonable control of Company. Under such circumstances, Company shall be entitled at its option to either extend the time of delivery until a reasonable period after such cause has ceased or to terminate the sale and in neither case shall the customer have any claim of loss or damage against the Company.
PRODUCT RETURNS
Any unopened unused items may be returned within 30 days of purchase for credit less a 20% handling and restocking fee. Customer pays for return shipping. Once product has been received and inspected in good condition processing of return will occur. Please allow 4-6 weeks for processing. Contact us directly at info.bc2a.com or call at 800-776-2877 for any questions regarding returns. In the event of a sale or promotion of product, product is not eligible for return.
PRODUCT PURCHASES/CANCELLATIONS
The customer may not alter, change address, or cancel an order with Company without prior written consent once product has been dispatched. We reserve the right to cancel any purchase if product listed is at incorrect price due to typographical error or insufficient inventory. If we do cancel a purchase, you will receive a credit to your credit card. Your acknowledgement of credit is your sole remedy. Our receipt of an electric or other confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Company reserves the right at any time after receipt of your order, without prior notice to you, to cancel any such orders whether the order has been confirmed and your credit card charged.

Equine Sports Performance® participates in the BSCG Certified Drug Free Program.
The BSCG Certified Drug Free® for Equine Athletes program provides assurance that dietary supplements, natural products, nutrition/food items, cosmetics/creams, medical devices or related products, and/or ingredients or raw materials used in the manufacturing of such products, are free of performance enhancing drugs and/or other prescription, over-the-counter, or illicit substances that can lead to health concerns or positive drug tests for competition or companion animals. As part of the program, individual batches are tested for more than 1,300 substances including most of those on the “Association of Racing Commissioners International, Inc. Uniform Classification Guidelines for Foreign Substances” or on the “Equine Prohibited Substances List” as defined by the Federation Equine International (FEI). These prohibited substance lists, or a subset thereof, are used internationally for competition animals and include drugs banned by the American Graded Stakes Committee, FEI, USEF, greyhound racing, camel racing and other jurisdictions. This Batch Certification verifies that samples of the item identified by brand name, product name, and batch number below have been tested by ISO/IEC 17025 accredited instrumental screen using liquid chromatography/mass spectrometry (LC/MS) and that no compounds were detected according to the details and method detection levels in the BSCG Certified Drug Free® www.bscg.org.
While our products have been thoroughly tested and found to be effective, this certification information is not to be intended as a substitute for the full and total responsibility of the owner”s”, rider”s”, trainer“s”, or veterinarian”s” of said equine or equines at event, competition, clinic or any activity to review all banned substances, prohibited substances, foreign substances lists with all necessary equestrian governing bodies prior to competition. Nothing contained in this certification service is intended to be or should be taken for drug free clearance prior to and/or at competition.
PAYMENT METHODS
We currently accept credit card and debit card payments, including Visa, Mastercard and American Express. We use the World Pay and Stripe System as our gateway. You are subject to the World Pay and Stripe Legal Agreement when performing a transaction with the Equine Sports, Inc.-Equine Sports Performance®.
